{"id":229,"date":"2011-09-01T17:38:12","date_gmt":"2011-09-02T00:38:12","guid":{"rendered":"http:\/\/www.enannysource.com\/blog\/?p=229"},"modified":"2014-02-18T04:55:36","modified_gmt":"2014-02-18T12:55:36","slug":"is-the-california-domestic-workers-bill-of-rights-good-for-nannies-and-families-or-an-example-of-the-nanny-state","status":"publish","type":"post","link":"http:\/\/www.enannysource.com\/blog\/index.php\/2011\/09\/01\/is-the-california-domestic-workers-bill-of-rights-good-for-nannies-and-families-or-an-example-of-the-nanny-state\/","title":{"rendered":"Is the California Domestic Workers Bill of Rights Good for Nannies and Families or an Example of the Nanny State?"},"content":{"rendered":"<p>In California there\u2019s been quite a bit of talk and some hysteria over a proposed bill, <a title=\"California Babysitter Law\" href=\"http:\/\/www.leginfo.ca.gov\/pub\/11-12\/bill\/asm\/ab_0851-0900\/ab_889_bill_20110712_amended_sen_v94.html\" target=\"_blank\">The Domestic Workers Bill of Rights <\/a>or California 889.\u00a0\u00a0 The bill essentially requires domestic workers to be paid minimum wage and time and one-half based on the same rules as other workers.\u00a0 It also requires employers to give their employee a paycheck stub that reports hours worked, pay, and deductions.<\/p>\n<p>The provision that\u2019s causing some hysteria and panic amongst families is the provision that requires the employer to give the nanny a 10 minute break every 4 hours and a 30 minute break every 5 hours.\u00a0 People are saying they\u2019ll have to hire two nannies to cover the time off.\u00a0 Does that really make sense?\u00a0 Don\u2019t nannies get breaks now when the child is napping or watching TV?\u00a0 How is this different from a mom talking on the phone and keeping an eye on her child at the same time?\u00a0 Or, mom grabbing lunch while keeping an eye on their child.\u00a0 Surely, the law doesn\u2019t intend a break where the nanny leaves the child alone.\u00a0 Personally, I think this reaction has to do more with people claiming \u201cnanny state\u201d than reality.<\/p>\n<p>The part of the bill that will cause some pain will impact mainly seniors that have caregivers and senior care agencies.\u00a0 This is because of the rules requiring live-in caregivers to have 8 hours off to sleep in a 24 hour shift and rules regarding pay.\u00a0 This could be painful to seniors since it could drive up the cost of caregivers.<\/p>\n<p>From what I\u2019ve heard a similar-sounding law in NY state has had little impact on how <a title=\"Nanny Employers; Nanny Taxes\" href=\"http:\/\/www.enannysource.com\/nanny-taxes.aspx\" target=\"_blank\">nanny employers<\/a> and employees work.
